Terms of service
By clicking "Pay Now" you confirm that you have read, understood, and agree to all terms and conditions set forth below This agreement is binding at the time your order is submitted.
1. Order Acceptance and Processing
All orders are subject to acceptance by Edmunds' Roses ("we", "us", and "our"). Submission of an order constitutes your offer to purchase; no contract exists until we confirm acceptance via order confirmation email and/or generating an order confirmation number. Note: payment is processed at the time the order is placed.
Your credit card statement will reflect a charge from "EDMUNDS ROSES" or a similar merchant descriptor associated with this order. If you do not recognize this descriptor, please contact us before disputing the charge with your card issuer - see Section 5.
Orders are processed promptly upon receipt for hardgood items that are in stock, or plant items that have begun shipping to your location, often within hours of placement. Shipment of orders placed by mail and paid by check may be held until payment clears.
2. Cancellation Policy
2.1 Pre-Fulfillment Cancellation
You may request cancellation of an order by contacting our Customer Service team as soon as possible after an order is placed. We will make every reasonable effort to accommodate cancellation requests received before an order has been sent to the fulfillment areas. Orders for pre-booked seasonal items, live plants, and bareroot items enter fulfillment processing according to your USDA hardiness zone and weather conditions, within the shipping windows described in Section 3.
Because orders may enter automated fulfillment processing at any time, including outside business hours, submitting a cancellation request does not guarantee we will review or act on it before fulfillment begins. Requests are handled in the order received during our posted business hours (8:00AM to 4:00PM Central Standard Time). Cancellation requests submitted by voicemail, email, or social media outside of business hours are deemed received when our Customer Service team reviews them during the next business day, not when transmitted. For time-sensitive cancellations, we recommend calling rather than emailing.
Contact us to request cancellation:
- Phone: 262-265-5906
- Email: info@edmundsroses.com
- Hours: 8:00 to 4:00PM Central Standard Time
2.2 Orders In-Process, No Cancellation
Once an order has entered fulfillment, (including being picked, packed, labeled, assigned a tracking number, or tendered to a carrier) it cannot be cancelled, modified, or redirected. This applies regardless of whether the order has physically departed our facility.
3. Shipping, Delivery, and Risk of Loss
All orders are shipped Free on Board (FOB) Origin from our fulfillment facility. Title to merchandise and all risk of loss or damage pass to the customer upon handoff to the carrier.
Roses are shipped according to the estimated ship window for your USDA hardiness zone, communicated by our Customer Service, or printed/posted shipping dates. Spring bareroot roses ship while dormant and will not display foliage on arrival;this is expected and is not a basis for a damage or non-conformity claim. Summer roses are shipped in one-gallon pots, defoliated.
We are not responsible for delays, losses, or damage that occur during transit, including those caused by:
- USPS, FedEx, SpeeDee Delivery, or other carrier delays or errors
- Incorrect, incomplete, or undeliverable addresses provided by the customer
- Mail forwarding or address changes not communicated to us prior to the shipment
- Weather events, natural disasters, or other circumstances beyond our control
Estimated delivery dates are not guaranteed. Shipping and delivery timelines provided by call center agents at checkout are estimates only.
Customers reporting non-delivery must contact us within fourteen (14) calendar days of the estimated delivery date. Failure to notify us within this window may limit our ability to investigate or remedy the issue and may affect the outcome of any related claim.
Shipping charges are not refundable.
4. Guarantee, Returns, and Refunds
Your satisfaction is important to us. If there are issues with the products you receive, please keep all contents and packaging and contact us within seventy-two (72) hours of delivery, except as otherwise provided in Section 4.1 for fail-to-grow claims. We reserve the right to request photos of the plants or products in question, or the return of any product deemed unsatisfactory, prior to approval of any adjustment.
4.1 Roses
Store credit in the amount of the purchase price, less shipping charges, will be issues one time for roses that fail to grow, provided they have been properly planted and cared for.
We must receive notice of roses that fail to grow within ninety (90) days of receipt.
Plant material purchased at a discount of 35% or more carries no guarantee beyond arriving in good condition (i.e. free of physical damage such as breakage, crushing, desiccation, or visible disease upon delivery). This limited guarantee does not extend to the plant's establishment, growth, or long-term performance. Claims must be submitted within seventy-two (72) hours of delivery in accordance with the documentation requirements stated in Section 4.4 or the claim will not be eligible for remedy.
This guarantee does not cover plants lost due to weather conditions, soil conditions, planting techniques, neglect, disease, pest damage, or other conditions outside our control.
4.2 Gardening Supplies and Accessories (Non-Growing Items)
Gardening supplies are satisfaction-guaranteed against material and workmanship defects and may be returned for a replacement or refund within thirty (30) days of receipt of the item(s).
4.3 Grade and Variety Conformity
We guarantee that roses sold of a stated grade (e.g. No. 1, No. 1.5) conform to that grade within recognized tolerances at the time of shipment. We make no other guarantee, other than replacement or store credit if a rose is confirmed to be mislabeled or misidentified as to variety. Notice of a suspected variety mislabeling must be received within one (1) year of delivery, as bloom characteristics needed to confirm variety are often not observable until the plant's first flowering. In all cases, our liability is limited to the purchase price of the item.
4.4 Damaged or Unsatisfactory Items: Documentation Required
If plants or products arrive damaged or in unsatisfactory condition, you must:
- Contact us within seventy-two (72) hours of delivery
- Retain all original packaging and contents
- Provide photographic documentation of the issue upon request
Claims received after this window, or without supporting documentation when requested, may not be eligible for remedy. Failure to report an issue and provide required documentation within this window constitutes the customer's acknowledgement that the item(s) were received in good, salable condition and waives any claim relating to the condition of the item(s) upon arrival.
4.5 Return of Plant Materials
Due to the perishable nature of live plants, we generally do not require or accept the physical return of plant material as a condition of a refund or credit voucher. Photographic documentation is typically sufficient to process your claim.
4.6 Refund Processing
Approved refunds will be issued to the original payment method or as store credit, as applicable. Every effort is made to process refunds as quickly as possible. Extended processing times are possible during our peak season. Shipping charges are not refundable, except where the issue is the result of our error.
4.7 Plant Patents and Propagation Restrictions
Many rose varieties we sell are protected by U.S. plant patents, trademarks, or both. Roses are sold for the purchaser's own non-commercial use. Asexual propagation (including but not limited to cuttings, budding, grafting, or division for propagation purposes) of a patented or trademarked variety without authorization from the patent or trademark holder is prohibited by law.
5. Dispute Resolution: Required Contact Prior to Chargeback
IMPORTANT: Before initiating any payment dispute, chargeback, or bank claim, you are required to contact our Customer Service department to provide us with a reasonable opportunity to resolve your concern.
We are committed to resolving customer concerns promptly and fairly. Most issues, including delayed shipments, damaged items, missing packages, and billing questions, can be fully resolved through direct communication with out team.
By placing an order, you agree that:
- You will contact us directly before filing a chargeback or payment dispute with your financial institution or card issuer
- You will allow us at least five (5) business days to investigate and respond to your concern before escalating to a third party
- You will not file a chargeback for any order for which you have already received a refund, store credit, replacement, or other compensation from us. Doing so constitutes double recovery and may result in reversal of the chargeback and/or referral for fraud review
- You will not retain merchandise and simultaneously pursue a chargeback for the same transaction, whether in lieu of or in addition to a refund, credit, or replacement already issued through our claims process described in Section 4
Failure to contact us before initiating a chargeback may be used as evidence in our dispute response to your card network, as it may indicate that the dispute resolution process was not followed in good faith.
6. Backorders and Product Availability
Roses are seasonal, living products subject to availability. If a product becomes unavailable after your order is placed, a substitution may be shipped, or a refund will be issued to your credit card or by refund check. Refund delays may occur during peak season.
Backorder notifications and estimated ship dates are communicated in good faith and are subject to changed based on crop conditions weather, and supplier availability. Delays in backorder fulfillment do not constitute grounds for cancellation of the remaining order or for a chargeback.
7. Pricing and Order Accuracy
Although every precaution is taken to ensure accuracy, errors in price, quantity, and.or specifications may occur. We reserve the right to correct such errors.
8. Limitation of Liability
To the fullest extent permitted by applicable law, our liability for any claim arising from an order, whether based on contract, warranty, negligence, or otherwise, is limited to the purchase price of the item(s) at issue. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
9. Governing Law
These terms are governed by the laws of the State of Wisconsin. Any dispute not resolved through direct communication shall be subject to binding arbitration or the jurisdiction of the courts of Columbia County, Wisconsin, as applicable.
